I am married to Russian woman since July 2013. It is a long story but I have known her for more than 5 years before we married. We live in the United States. However since October she is pregnant and changed completely and does not speak any English at home and sleeps with her son in one bed and I sleep alone. I tried to talk to her but she refuses to talk at all.

Now in my state it is not possible to divorce when you are not married for 1 year. So I wonder if it is at all possible to divorce in Russia now? She lives legally with me in the United States and has a residence card based on the fact she is married to me. If the answer is yes, could you help me with this? And what would be the costs?

Just FYI I take full responsibility of the baby and don’t want in any way dump her or something. But I believe that a child should grow up in a normal family situation and not in a house where husband and wife basically have no relation at all and do not communicate about anything. The few times she has spoken she said she believes she has made a terrible mistake by marrying me. And I must say that she may be right.

Is it more favorable for me to get a divorce or to prevent it?

If I should
try to divorce, where should I do it? And if I get divorce in one country, for example Russia, will all the others have to accept the decisions as per custody, alimony etc?

Is it possible to get a divorce without the consent of both sides in Russia, and do we have to be in or visit Russia?

If we get divorce in Russia, what will be the possible decisions of the court, if we prove alcoholism and what if we can't prove alcoholism? Alimony, custody, division of property/wealth, and others.

How can we prove alcoholism? Especially if we will not be in Russia during the divorce process?

What will be the effects of the decision of the court in Russia on the property abroad? For example if Russia decides the goods/properties should be divided, how will this be done in United States?

1) Can you clarify to me the discrepancy about the Hague convention? Why if Russia is a signatory country, they are allowing her to apply for divorce, when she haven't resided in Russia for several years. If she's using the registration on her parents address to prove her habitual residency, isn't it illegal? Some sort of fraud? What can be done in that case?

As far as I know, even if she applies for divorce in Russia, it won't be recognized internationally by the convention, as it didn't abide to the stipulations (this was what I talked with the lawyers on international family law in Canada).

2) Is it true that once she applies, even if I don't agree on her terms and don't sign her petition, they give I believe 3 months of concealing time, after which they can rule on her favor? Why would that be?

3) We never lived or intended to live in Russia, She even activated her Canadian residence and all along the year we've been planifying it, it was just in May when she backed off.

4) I never gave her express permission to take my daughter away from China, wouldn't that be a wrongful removing?

5) I believe there are several options that I can resource from (Human Rights, Hague convention, etc...).

6) What are the chances of making this case successful?

7) What would be the cost involved for following the full case?
